Terms of Service

These Terms of Service ("Terms") are a contract between you and Dovetail Ventures LLC ("Mostly Hostly", "we", "us"), a Texas limited liability company and the operator of the website-hosting service at mostlyhostly.com and its subdomains (the "Service").

By creating an account, or by using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business, and "you" means that business.

Our Privacy Policy explains what personal information we collect and how we handle it, and forms part of your agreement with us.

1. What the Service is

Mostly Hostly hosts small static websites — plain files and static-site generator output — for a limited group of customers. A typical site is a single page for a bar, café, or small business.

The Service includes:

• Hosting — we serve your site over HTTPS at a *.mostlyhostly.site address and, optionally, at a custom domain you own.
• A site builder — an onboarding wizard that uses an AI model to generate a first version of your site from information you provide, and an in-app "describe a change" tool for later edits.
• A git repository — your site's files live in a repository we host; you can connect your own editor and push changes directly.

The Service does not include: server-side application hosting, databases, email mailboxes, e-commerce checkout, or content management systems, unless we have agreed otherwise with you in writing.

2. Eligibility and your account

• You must be at least 18 and able to enter a contract.
• One person is responsible for each account. Keep your password and any access tokens secret; you are responsible for everything done through your account.
• Tell us promptly (hello@mostlyhostly.com) if you believe your account has been accessed without permission.
• We may require a valid access code or invitation to register.

3. Fees, free trial, and billing

• Current phase: the Service is provided free of charge while we are in a limited early-access phase. We may introduce fees at any time on reasonable notice by email.
• Free trial: if a paid plan is in effect, new sites may be published on a free trial for a stated period. If you have not started a paid subscription when the trial ends, the site is taken offline (a placeholder page is shown) but its files and settings are kept for the grace period in section 8.
• Subscriptions: paid plans renew automatically each period until cancelled. Fees are charged in advance and are non-refundable except where required by law. Cancelling stops future charges; it does not refund the current period.
• Payment processing: payments are handled by Stripe. We do not store your card details. Stripe's terms and privacy policy also apply to the payment.
• Taxes: stated prices exclude taxes unless we say otherwise; you are responsible for any taxes that apply to you.
• Usage allowances: plans include a monthly allowance of AI generations and edits and reasonable limits on storage, bandwidth, and build resources. If you exceed an allowance, that feature pauses until the allowance resets; we may contact you about sustained heavy use.

4. Your content

• You own your content. "Your content" means the text, images, logos, menus, code, and other material you upload, provide to the wizard, or push to your repository, plus the site built from it.
• Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, build, transmit, and display your content for the purpose of operating the Service and your site. This licence ends when your content is deleted from the Service, except for copies in routine backups until they age out.
• Your responsibilities. You represent that you have all rights needed to use your content and to grant the licence above, and that your content and your site do not infringe anyone's rights or break any law.
• Accuracy. You are responsible for the accuracy of what your site says — hours, prices, menus, claims about your business — including where an AI draft produced it.

5. Acceptable use

You must not use the Service to host, build, distribute, or link to:

• anything illegal, or anything that promotes or facilitates illegal activity;
• malware, phishing pages, credential-harvesting forms, or deceptive content;
• spam, or infrastructure that supports spam or bulk unsolicited messaging;
• cryptocurrency mining, proof-of-work, or other code whose purpose is to consume compute;
• sexually explicit material, or content that sexualises minors;
• content that harasses, threatens, defames, or incites violence or hatred against people based on who they are;
• material that infringes copyright, trademark, or other rights;
• another person's or business's identity, branding, or domain without authorisation.

You must also not:

• run server-side code, background jobs, or services beyond serving static files;
• probe, scan, or try to break the Service's security or isolation;
• circumvent usage allowances, rate limits, screening, or access controls;
• resell or sublicense the Service, or host sites for third parties as a service, without our written agreement;
• use the Service in a way that degrades it for other customers.

We run automated screening on every deploy. A build that trips the screen is rejected. We may also review sites and repositories manually where we have reason to.

6. AI-generated content

• AI drafts are provided "as is". They may contain errors, placeholder text, or design choices you do not want. Review a draft before you publish it.
• You are responsible for the published result regardless of how it was created.
• We do not guarantee that any two sites will look different, or that a style, layout, or wording is unique to you.
• The AI features depend on a third-party provider (currently OpenAI). The information you give the wizard and the edit tool is sent to that provider to produce the output. Do not put confidential information into these tools.

7. Custom domains

• If you connect a domain you own, you are responsible for keeping its registration and DNS current. We create the records needed to route and secure it while it is connected.
• HTTPS certificates are issued by Let's Encrypt; connecting a domain means you accept their subscriber agreement for that domain.
• If a connected domain stops pointing to us, or its registration lapses, the site remains reachable at its *.mostlyhostly.site address.

8. Suspension, termination, and offboarding

By you. You can delete a site at any time from the console. Deleting a site cancels any subscription for it (with no refund of the current period), takes it offline, and removes its files, DNS, and hosting. If the site was ever published, its repository is archived (read-only) for the grace period below so you can retrieve your content; a never-published draft's repository is removed immediately.

By us. We may suspend or terminate a site or account, with notice where practical and immediately where necessary, if:

• you break these Terms, in particular section 5;
• payment fails and is not resolved after we contact you;
• we are required to by law or a valid legal request;
• keeping the content online creates a security, legal, or reputational risk to the Service or other customers.

Grace period and data deletion. After a site is taken offline (by you, by a lapsed trial, or by us for non-payment), we keep its repository and settings for 14 days. During that window, re-subscribing or contacting us restores the site. After the window, the repository, files, uploads, and traffic history are permanently deleted and cannot be recovered. A never-published draft with no activity is removed after 5 days. Immediate termination for a serious violation may skip the grace period.

Export. Before deletion you can download your repository through the git access feature and export your traffic history from the console.

9. Third-party services

The Service is built on third-party providers for hosting, DNS and network security (Cloudflare), payments (Stripe), AI generation (OpenAI), HTTPS certificates (Let's Encrypt), email delivery, and off-site backups. Data necessary to provide the Service passes through these providers, each under its own terms, and their availability affects ours. Our Privacy Policy describes what each category of provider receives.

10. Backups

We take routine backups to help us recover the Service, but we do not guarantee they will be complete or current, and they are not a substitute for your own copy. Your site's files are in a git repository you can clone at any time — keep your own copy of anything you cannot afford to lose.

11. Service availability and changes

• The Service is provided on a best-effort basis with no uptime guarantee and no service credits.
• We may add, change, or remove features, and we may change these Terms. For material changes we will give notice by email to your account address before they take effect. Continuing to use the Service after that means you accept the change. If you do not accept it, stop using the Service and delete your sites.
• We may discontinue the Service entirely on 60 days' notice, during which you can export your content.

12. Disclaimers

To the fullest extent allowed by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free. We do not warrant AI output, search-engine treatment of your site, or the conduct of any third party.

13. Limitation of liability

To the fullest extent allowed by law:

• We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
• Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the fees you paid us for the Service in the 3 months before the claim or USD 50.

Some jurisdictions do not allow certain limitations; in those, the limitations apply to the extent permitted.

14. Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and costs (including reasonable legal fees) arising from your content, your site, your use of the Service, or your breach of these Terms.

15. General

• Governing law and venue: these Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and disputes will be brought exclusively in the state or federal courts located in Texas.
• Entire agreement: these Terms (with any plan-specific terms and our Privacy Policy) are the entire agreement between us about the Service.
• No waiver: not enforcing a term is not a waiver of it.
• Severability: if a term is unenforceable, the rest stays in effect.
• Assignment: you may not assign these Terms; we may assign them to a successor of the Service.
• Notices to you are sent to your account email; notices to us go to hello@mostlyhostly.com.
